Accused shouts for sentence

A MAN arrested in Albany three months ago shouted at a Magistrate on Tuesday for not sentencing him.

Andrew Duncan Baker (39) told Magistrate Elizabeth Hamilton “you must have issues if it’s going to take you three months to give me a sentence”.

Baker pleaded guilty in the Albany Magistrate’s Court on Tuesday for charges of endangering the life, health or safety of a person and breaching bail.

The court heard Baker was on Fredrick Street in Broome on August 9 at 12.45am.

He picked up a piece of brick and threw it at the window of a passing car.

Defence lawyer Kevin Prince said Baker was only defending himself as the car swerved at him.

The case had been adjourned from October 20 because Magistrate Elizabeth Hamilton wanted to access Baker’s interstate records.

She was concerned because he had multiple records for reckless and wilful acts in Victoria, New South Wales and South Australia.

Baker denied the records were his, so the case was adjourned again.
